Warranty

SPEAKMAN COMPANY CARRIES NO WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND, OR IMPLIED, INCLUDING NO WARRANTY OF MERCHANTABILITY OR OF FITNESS, AND NONE SHALL BE IMPLIED BY LAW.

The need for continuing improvement of products and other factors require the making of change from time to time in product design, material specification and rough-in dimensions. Therefore, the company does not warrant that its products as delivered conform to the description in its catalogs and other literature and such conformity is not part of the basis of the bargain between the seller and buyer.
All goods sold by Speakman Company are carefully manufactured, tested, inspected, checked and packed by experienced workers and are as free from defects as possible prior to leaving the factory. However, any goods sold by the company under the terms and conditions contained herein that may prove defective by reason of material workmanship within one year after shipment will be replaced or, at is sole option, repaired by the Company for the buyer invoiced by the Speakman Company. The Company will not, however, accept any charges for labor or expense required to replace defective material or damage caused thereby and any claim for damages, including consequential damages, is excluded. No returned material claimed to be defective by the buyer will be accepted without the Company's previous written permission setting forth the terms under which such return may be made.
Finish warranty - We do not guarantee or warrant the appearance of the finish due to varying atmospheric conditions. The finish warranty is limited to materials and workmanship at the time of delivery.
Products of other manufactures sold by Speakman Company are limited to the warranty extended to the Speakman Company by such manufacturers.
These warranties are in lieu of all other warranties, expressed or implied, and all other obligations or liabilities on the part of Speakman Company. The Company neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale of its products, except in the case of express warranties which may be issued only by the Company in writing when, at the Company's sole discretion, occasions, or circumstances may require such warranties.
